大法官宣告民法未保障同性婚姻而違憲，有關機關應於解釋公布之日起二年內完成相關法律的修正制定。行政院秘書長陳美伶31日表示，政院已成立專案小組，固定每星期開會，辦理配套法規研修及法案研擬等作業。而目前許多縣市採用同性註記，她個人傾向未來全部開放註記，下星期首次會議將與內政部溝通。
總統府對釋字748號解釋，請行政院部門後續依釋憲結果，儘速提出具體法律方案，送交立法院審議，務必如期完成三讀。陳美伶31日表示，行政院目前已啟動專案小組，未來每個星期至少開一次會議，儘速把後面法制作業做出來。將由法務部擔任幕僚機關，邀其總統府、內政部、外交部、財政部、衛福部、勞動部、本院陸委會及人事總處、司法院等相關機關共同與會。
陳美伶強調，她不看過去做了什麼，而是大法官解釋後，行政部門應該做什麼。親屬關係建立在血緣與婚姻上，權利義務怎麼做到保障，這是該努力的方向，「我認為大法官給我們很大空間，也給我們思考，在這樣空間下，如何取得大家的平衡；立法技術已經是末端，前端要做什麼，同性希望哪些權益受到保障？我相信他們要的不是形式關係，而是實質義務保障。」
對於外界目前討論該直接修改民法、或立專法、專章，陳美伶說，或許還有第四種方法，但這不是現在要給大家的答案。她提到，目前台灣有11個縣市已經辦理註記的工作 ，總共有2060對註記（女同志1643對、男同志417對），她個人傾向開放全部註記，將在下星期第一次會議中，與內政部討論，如果有縣市因自治法不願意跟進，或許看可否讓同志直接到內政部註記。
不過，陳美伶對於時間表的規劃，則說「不敢講」，理由是她已經有一段時間沒有接觸，也沒有教書。還有媒體問到通姦除罪化的議題，她認為，同志有關夫妻財產、子女撫養等法律修正會先進行，刑事處罰先會放一邊。
